Beta End User License Agreement

This End User License Agreement ("Agreement") is between you and Steven Frank ("Licensor") and governs your use of the dcs-mcp software, including the installer, server binaries, terrain data packages, and associated documentation (the "Software").

By installing or using the Software, you agree to this Agreement. If you do not agree, do not install or use the Software.

1. Beta Status

The Software is pre-release beta software provided for evaluation and feedback. It may contain errors, may change without notice, and features may be added or removed before any general release. Beta access, including license keys, is provided free of charge and may be modified, suspended, or revoked by Licensor at any time, including at the end of the beta period.

2. License Grant

Licensor grants you a personal, non-exclusive, non-transferable, revocable license to install and use the Software on devices you own or control, for your own use, subject to this Agreement and a valid license key.

3. License Keys and Validation

The Software requires a license key issued by Licensor. Keys are issued to individual users and may not be shared, sold, transferred, or published. The Software periodically validates your key against Licensor's servers; this validation transmits your key and basic version information. Continued use requires periodic successful validation.

4. Restrictions

You may not:

  • copy, distribute, sell, rent, lease, sublicense, or otherwise transfer the Software or any part of it;
  • reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software, except to the extent such restriction is prohibited by applicable law;
  • modify the Software or create derivative works from it;
  • circumvent or attempt to circumvent license validation or any technical protection measures;
  • use the Software to develop a competing product.

5. Ownership

The Software is licensed, not sold. Licensor retains all right, title, and interest in and to the Software. Mission files (.miz) and other content you create using the Software are yours.

6. Feedback

If you submit feedback, bug reports, or suggestions, you grant Licensor a perpetual, irrevocable, royalty-free right to use them without obligation to you.

7. Third-Party Software

The Software interacts with DCS World and other third-party software, which are governed by their own licenses. Licensor is not affiliated with Eagle Dynamics.

8. Termination

This Agreement is effective until terminated. It terminates automatically if you breach it, or upon revocation of your license key. Upon termination you must uninstall and cease all use of the Software. Sections 4 through 11 survive termination.

9. No Warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR USE, ARISING OUT OF OR RELATED TO THE SOFTWARE OR THIS AGREEMENT. LICENSOR'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE (WHICH, DURING THE BETA, IS ZERO).

11. General

This Agreement is governed by the laws of the State of Wisconsin, USA, without regard to conflict-of-law principles. If any provision is held unenforceable, the remainder remains in effect. This Agreement is the entire agreement between you and Licensor regarding the Software.
